This agreement is made between Video Financial Modelling and the Customer.
1. Definitions
- Customer – The recipient of any Products or Services.
- Excel – A spreadsheet program created by the Microsoft Corporation.
- Video Financial Modelling – Video Financial Modelling Pty Ltd ACN 147 230 395 and ABN 39147230395.
- Parties – together Video Financial Modelling and the Customer.
- PayPal – PayPal Inc. or any of its subsidiaries or affiliates.
- Product – The spreadsheets, PDFs, videos, audios, transcripts, and other files on the Site (whether free or paid for).
- Service – All services including workshops, seminars or consulting services.
- Services Agreement – An agreement between a Customer and Video Financial Modelling relating to Services rendered.
- Site – The website with domain name http://www.videofinancialmodelling.com, including any sub-domains.
2. Terms of Use
The Customer agrees to comply with all terms and conditions contained within this agreement.
3. Quality
Video Financial Modelling is devoted to providing Customers with quality Products and Services. Video Financial Modelling Products and Services are designed for training purposes only and they do not, in any way, constitute an investment thesis or recommendation. Customers should get the necessary financial advice when evaluating financial opportunities or businesses and Video Financial Modelling in no way takes any responsibility for the incorrect use (whether negligent or not) of their Products or Services.
4. No Affiliation with the Microsoft Corporation
The Customer realizes that Excel is a registered trademark of the Microsoft Corporation and Video Financial Modelling, including its Products and Services are not in any way associated or affiliated with Microsoft Corporation.
5. Privacy
Video Financial Modelling takes the Customer’s privacy seriously. Video Financial Modelling takes strong measures to protect the Customer’s privacy. First, we only ask you to provide information that we need in order to deliver the Products or Services you have requested. Furthermore we don’t share the information you have given us, unless required by Law.
6. Customer Representations and Warranties
The Customer represents that they are 16 years of age older and/or has sought the consent of their parent or guardian.
7. Copyright
The content and Products on this Site, as well as the Services are the property of Video Financial Modelling; all which are copyright 2010 Video Financial Modelling (or date of first publication) and protected by laws and regulations governing copyright and trademark. You agree not to modify, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any such material without the express written permission of Video Financial Modelling.
8. Payment
Video Financial Modelling policies and prices are subject to change without notice. Any price changes become effective immediately after such change. Video Financial Modelling will use best endeavors to inform Customers of any such price changes. The payment for Products and Services is outlined below.
i) Products
Video Financial Modelling uses PayPal to process Product payments. Despite PayPal’s reputation in the industry, Video Financial Modelling do not take any responsibility for infiltration of the Customers payment information.
Video Financial Modelling only accepts United States Dollars for Products and any foreign currency exchange shall take place according to PayPal’s foreign exchange policy. Payment for Products will be deemed to have taken place once money is cleared and received in a Video Financial Modelling nominated bank account.
ii) Services
Customer payment to Video Financial Modelling Pty Ltd for Services will be governed by a Services Agreement.
9. Delivery
i) Products
Video Financial Modelling Products will be delivered electronically via an email link. If the Customer has problems with receiving the relevant Product then they may request Video Financial Modelling to send the product via another method such as email or post (any charges such as postage would be at the Customers expense). Video Financial Modelling may alter its delivery policy at any time without prior consent from the Customer. Electronic delivery for Products will occur at practically the same time as payment in clause 8)i) above.
ii) Services
Delivery for Services will be governed by the Services Agreement.
10. Product Money Back Policy
All Products on this site are backed by 30-day money-back guarantees. At any time within your 30-day period from delivery you have the right to request a full refund for Products rendered. Any money-back guarantees for Services will be dealt with under the Services Agreement.
11. Complaints Handling Procedure
Video Financial Modelling is committed to delivering Customers with quality Products and Services. This being said if the Customer has any complaints or issues relating to our Products or Services, we will do our best to solve them in a quick and equitable fashion. If the Customers complaints or issues are still not satisfied they may refer the issue to Dispute Resolution as outlined in clause 12.
12. Dispute Resolution
Where an issue cannot be resolved using the Complaints Handling Procedure (Clause 11) the Customer or Video Financial Modelling may refer the dispute to the Queensland Office of Fair Trading or any other party as mutually agreed by the Parties.
13. Governing Law
This agreement is governed by and interpreted under the laws of the state of Queensland, Australia. If any provision of this agreement is held to be invalid or unenforceable, that provision shall be deleted and the remaining provisions shall be enforced.
By using this Site, Products or Services the Customer “Accepts” and agrees to be bound by this Terms and Conditions Agreement.
